Usage of jlauser.net Web Hosting Services is subject to the following Terms of Service. Violation of these Terms of Service may result in termination of service without notification or refund of fees paid. These Terms are subject to change without notifation.
jlauser.net Web Hosting Services includes storage, processing, and delivery of hypertext content via the World Wide Web and processing and/or storage of electronic mail.
Web hostingWeb hosting is provided by the open-source Apache HTTP Server. Secure web hostingSecure web hosting is available, however, the client is responsible for supplying the SSL certificate(s), and is responsible for keeping the certificate(s) up to date. Additionally, a fee of $5/mo will be charged for EACH secure subdomain requested. Server-side scriptingServer-side scripting is provided by PHP, Perl, Python, and Ruby modules for Apache. Scripts written in PHP, Perl, Python or Ruby may be installed anywhere in the client's page, however, such scripts will NOT be supported by jlauser.net staff, with some minor exceptions. Clients are responsible for maintaining these scripts on their own. Scripts that use a disproportionate quantity of server resources or represent security issues may be disabled. Additionally, scripts that have infinitely deep links (e.g. phpicalendar) MUST be protected using a robots.txt file. Contact jlauser.net staff for assistance with this, if necessary. DatabasesClients may have databases stored on the server. This service is available to all users free of charge. The database engine is MySQL, and is accessible via PHP, Perl, Python and Ruby extensions or modules. There is no limit to the number or size of databases a client may have, but the storage used will count against quotas. Excessively large databases will degrade server performance, however, and may be subject to review by jlauser.net staff. To have a database created, contact jlauser.net staff. Mail forwardingElectronic mail forwarding is provided for all users. Users may define any number of forwarding accounts. Additionally, a "catch-all" address may be defined. Messages sent to forwarding addresses will be received by the server, and then immediately retransmitted to another address. The server will store these messages in a queue for up to one week and periodically attempt retransmission, should the final address be temporarily unreachable. jlauser.net takes no responsibility for forwarded mail beyond this. Mail hostingElectronic mail hosting is also provided for all users. Users may have up to five (5) hosted mail accounts free of charge. Additional accounts are available for a nominal fee. Messages will be stored on our servers indefinitely. Access to mail will be provided by SSL encrypted POP3 or IMAP access. SSL encrypted, authenticated SMTP access is also provided. Web-based access to electronic mail is also available, via a secure website. Storage used for mailboxes will count against disk quotas, but is not specifically limited. Mailing listsAll users may have any number of mailing lists created, free of charge. Mailing lists are maintained via a simple, web-based interface. There is no limit to the number of addresses that can be signed up to a mailing list, but lists that use a disproportionate amount of bandwidth or CPU resources may be subject to review. To have a mailing list created, contact jlauser.net staff. Once a list is created, it is the responsibility of the list owner to maintain the list. |
Disk usage is limited to four (4) gigabytes (4,294,967,296 bytes) per account. Additional storage is available for a nominal fee. Disk usage is calculated as the total storage used by web documents, hosted e-mail, and databases. A notification via e-mail will be sent if storage limits are violated, and ignoring said notifications will constitute a violation of the Terms of Service.
Bandwidth usage is not "capped", but the bandwidth available to the server is finite. The server is currently connected to a shared link to the Internet. Sites that use an excessive amount of bandwidth may be dynamically throttled to prevent performance loss to other sites, but at no point will requests be denied due to bandwidth usage.
Each account may only have one domain associated with it by default. Additional domains may be associated for a nominal fee. Registration of domain names is not included in the service, and must be provided by the client. DNS hosting, however, is available free of charge upon request. Users may define any number of subdomains free of charge. Additionally, if users do not wish to register their own domain names, one subdomain of jlauser.net will be assigned. Access to the server by IP address is not permitted. Note that if clients do not supply their own domain name, all mail-related services are forfeited.
The server is currently backed up automatically every night to an off-site location, in case of failure. Only the most recent version of what is on the server is stored. These backups are NOT guaranteed, and are not accessible by the client. jlauser.net staff will not be responsible for recovering data lost due to accidental deletion of files.
Shell access to a protected console is provided. Shell access provides a way to modify and interact with files directly, rather than only via SFTP. The shell environment is highly secured and will not allow network access.
Reasonable attempts to keep the server secure have been made.
Automated monitoringOne of the methods used for security is an automated monitoring program which runs all the time, looking for break-in attempts. If a break-in attempt is identified, the IP address of the origin of the attack will be blocked from access to the server for up to one week. This service is mandatory. Security violationsAny intentional attempt to circumvent the security systems in place on the server, or attempts to gain shell access or access to other clients' data will result in immediate termination of service without refund. SpamUse of the server to distribute unsolicited electronic mail (commonly known as "spam") is not permitted. Violation will result in immediate termination of service without refund. |
No server-side filtering of electronic mail is performed by default on hosted accounts other than verification of SPF records. This means that any spam or viruses transmitted via electronic mail will be sent on to clients. It is the clients' responsibility to deal with spam and viruses. For hosted accounts, mail stored on the server counts against your disk usage.
Available spam filtering systemsSpam filtering based on the technique called "greylisting" is also available. See Greylisting.org for more information about what greylisting is and what it does. Greylisting is available as an opt-in service for hosted accounts. Additionally, the extremely power spam-filtering system SpamAssassin is used to scan all mail delivered to the mail server. SpamAssassin is highly customizable and the spam-filtering rulesets are maintained by a large community of developers. The rulesets loaded on the mail server are automatically updated daily. Spam filtering for mail forwarding accountsFor forwarding mail accounts, greylisting is an opt-out service for normal addresses, as opposed to opt-in for hosted accounts, and is mandatory for catch-alls. This means that unless a user specifically requests that greylisting be disabled for a certain address, it will be enabled. If a user wishes to have a catch-all set up for his or her domain, only specifically defined address may be opted out, not the entire catch-all. This requirement does not apply to hosted accounts, or even hosted catch-alls. |
Contracts are month-to-month. If at any time the client wishes to terminate service, simply let jlauser.net staff know, and the account will be terminated at the end of the month.
Payment is due by the first day of every month. A grace period of seven (7) days is allowed. If payment is not received after the grace period, the account will be suspended. If payment is not received by the end of the month, the account will be deleted. The first month's payment will be pro-rated based on the number of days remaining in the month for the service start date.
Accounts may pre-paid for any duration. If an account is pre-paid for more than 6 months, a 5% discount is applied. Pre-payments of more than one year will receive a 10% discount. If a client wishes to terminate service before the end of their pre-payment period, the remaining funds will be returned in full, unless termination occurs before the end of a discount period. If an account is terminated before the end of a discount period, the discount will be corrected, the fees for the months used will be recomputed, and any remaining funds will be refunded.
Fees may change over time as operating costs go up or down. Changes to fees will always occur at the start of a billing period (the first of the month) and will be announced at least one (1) full month ahead of time. In the event of an increase in fees, clients will be required to pay the increased amount at the time of their next billing. Clients that have pre-paid their accounts will not have to pay the increased fee until their pre-payment period is over. In the event of a decrease in fees, clients that have pre-paid their accounts will have the option of receiving a refund of the difference in fees, or having the difference credited to their account.
jlauser.net staff take no responsibility for any content stored on the server whatsoever. Clients agree that they will not use jlauser.net services for unlawful purposes (including, without limitation, infringement of copyright or trademark, misappropriation of trade secrets, wire fraud, invasion of privacy, illegal pornography, obscenity, defamation, and illegal use, transportation or sale of tobacco, controlled substances and firearms), or to interfere with, or disrupt, other network users, network services, or network equipment. Disruptions include, without limitation, distribution of unsolicited advertising or chain letters, repeated harassment of other network users, wrongly impersonating another user, falsifying one's network identity for improper or illegal purposes, sending unsolicited mass e-mailings, propagation of computer viruses, using the network to make unauthorized entry to any other machine accessible location, via the network, and distributing of tools designed for compromising security (i.e. including, but not limited to, password guessing programs, cracking tools or network probing tools). jlauser.net may suspend or terminate the services immediately, without prior notice to the client, if jlauser.net staff believe, in good faith, that the client is utilizing the services for any such illegal or disruptive purpose. The client shall defend, indemnify, and hold harmless jlauser.net from and against all liabilities, judgments, claims, damages, settlements, expenses and costs (including reasonable attorneys' fees and litigation expenses) arising out of or relating to any and all claims by any person relating to use of the services, including, but not limited to, use of the services without consent of the client.
jlauser.net's liability (including, for purposed of this paragraph only, and of its employees, agents, or representatives), to the client (either directly or as a third party defendant in any action or proceeding) for any claim arising out of or relating to this agreement or agreement or the provision of any services under agreement (including, without limitation, maintenance and support) shall be limited to the amount of fees paid by the client to jlauser.net under this agreement within one year preceding the date the client contends its claim arose. In no event shall jlauser.net be liable for any loss of data, loss of profits, cost of cover, or any other special, incidental, consequential, indirect or punitive damages, however caused and regardless of theory of liability. This limitation will apply even if jlauser.net has been advised of, or is aware of, the possibility of such damages.
